The plain-English version, then the formal one. Both apply.

Kacmazsa provides (a) a marketplace for surplus, cancelled-order and B-grade Turkish apparel and home-textile lots, (b) software that drafts quotes, customs documents (A.TR, EUR.1, commercial invoices, packing lists), and landed-cost estimates, and (c) orchestration of pre-shipment inspection, freight, and milestone escrow through third-party partners.
You must be 18 or older and acting on behalf of a registered business. By submitting a listing you confirm you have the authority to sell the goods you describe; by submitting an RFQ you confirm you are sourcing in good faith.
Kacmazsa is an intermediary. The contract for the goods is between the supplier and the buyer. Kacmazsa is not a party to that contract and does not warrant the goods. Where Kacmazsa drafts documents, the parties remain responsible for their accuracy and for filing them with the appropriate authorities.
Suppliers must declare honestly: quantity, condition (overrun / cancelled-order / B-grade / mixed), defect rate, certifications, packaging, and lead time. We may remove listings that misrepresent these.
Pre-shipment inspection is performed by independent providers (e.g. SGS, QIMA) under their own terms. Their reports describe the goods at the time of inspection; they do not guarantee the goods will remain in that condition at delivery.
Funds flow through Kacmazsa's payments partner under the 10/70/20 milestone waterfall described on the buyers and home pages. Kacmazsa does not hold buyer or supplier funds on its own balance sheet. Fees applicable to a transaction (success fee, payment-protection fee, FX spread, freight margin, inspection admin fee) are disclosed in the order summary before you confirm.
If a buyer raises a claim within the claims window, the 20% final tranche is held until the claim is resolved. Claims are evaluated against the inspection report, the Lot Passport, and the shipped documents. Kacmazsa's role is to administer this evidence; it is not an arbiter of the underlying contract.
No counterfeit goods, no infringement of third-party trademarks or copyrights, no goods subject to EU, UN, US or Turkish sanctions, no dual-use or controlled goods without the necessary licences, no fraud, no automated scraping of the platform.
Kacmazsa retains all rights in its software, design, branding, and the data products derived from platform activity. You retain the rights in the content you submit, but grant us a licence to use it to operate the service.
To the maximum extent permitted by law, Kacmazsa's total liability arising from your use of the service is capped at the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential losses.
These terms are governed by Turkish law for matters relating to suppliers and platform operations, and by the law of England and Wales for matters relating to non-EU buyers, unless mandatory consumer-protection law of the buyer's habitual residence applies.
We may update these terms; we will notify registered users by email of material changes and post the updated text here.
