Terms of Business

These terms govern use of the Kacmazsa platform by buyers and suppliers. Last updated: May 2026.

Terms of Business

1. Scope and parties

These terms govern the use of the Kacmazsa platform by buyers (European wholesale buyers placing sourcing requests) and suppliers (Turkish manufacturers listing stock). References to "Kacmazsa", "we" or "us" mean the Kacmazsa platform operator. By submitting an RFQ or lot listing, you agree to these terms.

2. For buyers — how orders work

  • Buyers submit sourcing requests or reserve lots via the Kacmazsa platform.
  • A 10% reserve deposit locks a lot. This deposit is held by Kacmazsa's regulated payments partner — not by the supplier — and is refundable if the supplier fails to perform or fails pre-shipment inspection.
  • 70% of the lot value is due after pre-shipment inspection is passed and shipment documents are uploaded.
  • The final 20% is due after delivery and expiry of the claims window (14 calendar days from confirmed receipt).
  • Buyers are responsible for import customs clearance, import duty/VAT (if applicable), final-mile delivery, and any obligations imposed by their local regulations on the goods purchased.
  • Kacmazsa does not guarantee that goods will meet every buyer-country regulatory requirement beyond what is declared in the Lot Passport.

3. For suppliers — listing and fees

  • Listing is free. No upfront fee.
  • A success fee of 3–5% of closed order value (supplier side) is deducted at payout. The exact rate is confirmed in writing before order confirmation.
  • Suppliers must provide accurate information in the Lot Passport. Misrepresentation of grade, quantity, compliance documents, or origin is grounds for suspension and may result in claim liability.
  • Suppliers agree to allow pre-shipment inspection by a Kacmazsa-nominated third party (SGS, QIMA or equivalent) before payment release.
  • Payment to the supplier is released by the payments partner after milestone conditions are met — Kacmazsa does not hold supplier funds directly.

4. Platform role and limitations

  • Kacmazsa is a workflow and trust intermediary, not a trading house, principal buyer, or seller.
  • We do not own inventory, extend credit, or carry claims risk on our balance sheet.
  • Escrow and milestone payment services are provided by a third-party regulated payments partner.
  • Pre-shipment inspection is conducted by independent inspection firms — Kacmazsa coordinates booking and document collection but is not the inspection provider.
  • Kacmazsa's liability is limited to the fee received for the transaction in question.

5. Prohibited goods

Kacmazsa does not facilitate transactions involving: food and beverages, medical devices or pharmaceuticals, defence or military goods, controlled chemicals, hazardous materials, branded/counterfeit goods, animals or animal products, cultural property, goods subject to international sanctions, or any goods prohibited by EU, UK, or Turkish export/import regulations.

6. Claims and disputes

Buyers may file claims within 14 calendar days of confirmed goods receipt. Full claims policy at /claims.html. Kacmazsa will review claims against the Lot Passport and pre-shipment inspection report. Kacmazsa's determination is final for disputes under €5,000; above that threshold, either party may request escalation to an independent third-party assessor.

7. Data and confidentiality

  • Buyer sourcing details (budget, company, category, timeline) are not shared with suppliers without buyer approval.
  • Supplier floor prices are never disclosed to buyers.
  • Platform data is used only to match buyers and suppliers and process transactions.
  • See /privacy.html for full data processing information.

8. Governing law

These terms shall be governed by and construed in accordance with applicable law. Jurisdiction and applicable law to be confirmed in formal Terms of Business documentation. For commercial correspondence: hello@kacmazsa.com.
